Important Notices
This app is intended for general wellness and emotional check-ins. It does not diagnose, treat, or monitor any medical or mental health condition. Information provided through this app is based on self-reported inputs and is not reviewed by licensed healthcare professionals.
We value your privacy. All emotional wellness data is stored securely. If you access Wellify through an employer program, your employer may receive group-level analytics and certain individual-level roll-up metrics (e.g., a time-windowed aggregate mood score, counts of classes completed, and counts of activities completed), but not your specific mood entries, not which classes or which activities you engaged in, and not any journal or message content. See Section 9 (Data Use, Privacy & Employer Programs).
This app is not a medical device and is not subject to HIPAA regulations unless used in conjunction with a covered healthcare entity. For personal mental health support, please consult a licensed provider.
Some content in the app—including text, images, audio, and other media—may be generated or enhanced by artificial intelligence. See Section 7 (AI‑Generated Content and Outputs).

1. Acceptance of Terms
By accessing or using the Wellify application or services, you agree to be bound by these Terms of Service (“Terms”). If you do not agree, please do not use Wellify.
2. Eligibility
You must be at least 18 years of age to use Wellify. By using the app, you represent and warrant that you meet this age requirement.
3. User Accounts
You are responsible for maintaining the confidentiality of your account information and for all activities that occur under your account. You agree to provide accurate and complete information.
4. License and Access
Wellify grants you a limited, non-exclusive, non-transferable, and revocable license to access and use the app for personal, non-commercial purposes in accordance with these Terms.
5. Prohibited Conduct
You agree not to:
Use Wellify for any unlawful purpose;
Impersonate another person or entity;
Interfere with or disrupt the app or servers;
Upload or share harmful, offensive, or inappropriate content;
Reverse engineer, decompile, or disassemble any part of the app.
6. Intellectual Property
All content and materials within the app, including trademarks, logos, text, images, and software, are the property of Wellify or its licensors and are protected by intellectual property laws. You may not use any content without prior written permission.
7. AI‑Generated Content and Outputs
7.1 AI Use. The Services may generate or enhance content (including text, images, audio, recommendations, and other outputs) using artificial intelligence and machine learning (“AI Outputs”). Some images and other media you see in the app may be synthetic or AI‑created.
7.2 No Professional Advice. AI Outputs are for informational and wellness‑support purposes only and may be inaccurate, incomplete, or reflect unintended bias. Do not rely on AI Outputs for medical, legal, financial, or other professional advice.
7.3 Your Inputs. You represent and warrant that you have the rights to the prompts, data, or materials you submit (“Inputs”). You grant Wellify a non-exclusive, worldwide, royalty‑free license to process Inputs to provide and improve the Services, including to generate AI Outputs for you.
7.4 Your Use of Outputs. Subject to these Terms and applicable law, Wellify grants you a limited, non‑exclusive license to use AI Outputs for your personal, non‑commercial purposes. You are responsible for your use of AI Outputs and compliance with applicable laws, including disclosure obligations where required.
7.5 Content Review. To operate, secure, support, and improve the Services; to investigate abuse; and to comply with law, Wellify (and its service providers acting on its behalf) may review limited samples of Inputs and AI Outputs as described in Section 9 and our Privacy practices.
7.6 No Warranties; Third‑Party Models. AI features may rely on third‑party models or providers. Wellify makes no warranties regarding the accuracy, completeness, or reliability of AI Outputs.
8. Paid Services and Subscriptions
Some features of Wellify may require payment. All fees are non-refundable except where required by law. We reserve the right to change pricing with reasonable notice. Subscriptions auto‑renew unless canceled.
9. Data Use, Privacy & Employer Programs
9.1 General Data Use. We collect and process data to operate, maintain, secure, and improve the Services; to provide customer support; to personalize your experience; to comply with legal obligations; and as otherwise described in these Terms. Limited, role‑based, and audited access by authorized personnel or service providers may occur for these purposes.
9.2 Categories of Data. Depending on how you use the Services, we may process: account details, device information, usage analytics, and your self‑reported wellness entries or check‑ins. Sensitive data (if any) is handled with heightened safeguards.
9.3 Sharing with Employers (Employer Programs). If you access Wellify through an employer‑sponsored program, your employer may receive (A) group‑level analytics about program usage and outcomes (e.g., enrollments, feature adoption, engagement levels, completion of activities) and (B) certain individual‑level roll‑up metrics for enrolled participants, limited to: (i) a time‑windowed aggregate mood indicator for the individual (e.g., an index, band, or score computed over a defined period), not any specific mood labels, or entries; (ii) the total number of classes the individual has completed (counts only); and (iii) the total number of activities or sessions the individual has completed (counts only). Employers do not see which specific classes or which specific activities were taken, nor the content of any journal entries, messages, or free‑text inputs.
9.4 What Employers May See. Subject to the prior paragraph, employers may also see limited participant‑level operational fields required to administer the program (e.g., eligibility status, enrollment/activation dates, incentive fulfillment status). Employers do not receive your specific wellness entries, message contents, exact per‑entry moods, or personally attributable sentiment values, and they cannot view which classes or which activities you engaged in. Where necessary to reduce the risk of inference or re‑identification, Wellify may apply minimum aggregation windows, smoothing, or suppression.
9.5 Disclosures You Control. Certain features may offer you the option to export, share, or connect your data to third‑party services (including employer systems). When you choose those features, you direct us to share the selected data with the chosen recipient.
9.6 Service Providers. We use third‑party processors (e.g., hosting, analytics, customer support) under contracts requiring appropriate confidentiality and security.
9.7 Safety, Security, and Legal Compliance. We may access, preserve, and disclose information when we believe it is reasonably necessary to: respond to lawful requests; enforce these Terms; detect, prevent, or address fraud, security, or technical issues; or protect the rights, property, or safety of users, Wellify, or the public.
9.8 Privacy Practices. Additional details about data handling, retention, and your choices may be provided in our Privacy notices made available in the app. In case of conflict, those notices govern our privacy practices.
10. Termination
We reserve the right to suspend or terminate your access to Wellify at any time for violation of these Terms or applicable laws. You may also terminate your account at any time.
11. Disclaimers
Wellify is provided on an “as is” and “as available” basis. We do not guarantee that the app will be uninterrupted, secure, or error‑free. We do not provide medical advice— all health‑related content is for informational purposes only.
12. Limitation of Liability
To the fullest extent permitted by law, Wellify and its affiliates shall not be liable for indirect, incidental, punitive, or consequential damages, or any loss of profits or revenues. Total liability shall not exceed the amount paid by you, if any, in the twelve (12) months preceding the claim.
13. Indemnification
You agree to indemnify and hold harmless Wellify, its affiliates, officers, employees, and agents from any claims, liabilities, damages, or expenses arising out of your use of the app or violation of these Terms.
14. Governing Law and Dispute Resolution
These Terms are governed by the laws of the State of Delaware, without regard to its conflict of laws rules. Any disputes shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.
15. Third‑Party Services
The app may link to third‑party websites or services. We are not responsible for their content or practices. Use of third‑party services is at your own risk and subject to their terms.
16. References & Attribution
Any references, citations, quotations, or excerpts displayed in the app are provided for informational purposes. All rights in such referenced works remain solely with their respective authors and rights holders. All third‑party trademarks, logos, and brand names are the property of their respective owners. Their appearance in the app does not imply endorsement.
17. Modifications to Terms
We may update these Terms from time to time. Continued use of the app after changes means you accept the new Terms. We will provide notice of material changes.
18. App Store Requirements
This Agreement is between you and Wellify, not Apple or Google. However, both Apple Inc. and Google LLC, and their subsidiaries, are third‑party beneficiaries of these Terms. By using the app, you agree that Apple and Google have the right to enforce these Terms against you.
Use of the app must also comply with the applicable App Store Terms of Service, including but not limited to: Apple Media Services Terms and Conditions; Google Play Terms of Service.
